Truck accident claims

When to call a truck
accident lawyer

A truck accident claim reaches past the driver to the companies behind the truck: the motor carrier that runs it, and in some cases the trailer owner, the shipper that loaded it or the broker that arranged the load. Most of the proof sits in their files, so the first days matter.

The claim asks for payment for your medical care, lost income and the ways the injury changed your life. If you lost a family member, read about wrongful death claims in Texas.

Questions

Truck accident questions

General questions about injury claims, such as deadlines and fault, are answered on our McAllen personal injury lawyer page.

How is a truck accident case different from a car crash case?

A truck case usually involves a company as well as a driver, federal safety rules, and records that only the carrier holds. That means more parties to investigate, more insurance to find and evidence that has to be requested early. For crashes between passenger vehicles, see our car accident claims in McAllen page.

Who can be responsible for a truck crash?

The driver and the motor carrier are the usual starting point. Depending on the facts, the trailer owner, the company that loaded the cargo, a repair shop or the broker that chose the carrier may share responsibility. We look at each one.

What if the truck or the trucking company is from Mexico?

You may still have a claim. Federal rules require a truck from a carrier based in Mexico to carry an English copy of its proof of insurance, and a truck without it is denied entry. We use that proof and the carrier's federal registration to identify the company and its insurer.

How do I get the truck's black box data and driver logs?

Through a lawyer, and quickly. We send the carrier a letter asking it to preserve the logs, engine data and video. Federal rules only require hours-of-service records to be kept for six months, and other data can be lost once the truck is back on the road.

How much insurance does a commercial truck carry?

For a for-hire truck hauling general freight between states or across the border, the federal minimum is $750,000 in liability coverage. Oil and many hazardous loads require $1 million to $5 million. Other companies tied to the load may have their own policies.

What if the driver was over the hours limit?

Driving past the federal limits can be evidence that the driver was too tired to drive safely, and a carrier that pushed the schedule may share responsibility. We compare the logs with GPS, fuel and delivery records to check them.
