When to call a slip and fall attorney
A slip and fall case is an injury claim against whoever owns or runs the place where you fell. Texas law expects them to fix a danger they know about, or should know about, or at least warn you about it.
Call us before you give a recorded statement to the property's insurance company or sign anything. Camera video and incident reports are easiest to get in the first days.

Notice
You must show the owner knew or should have known of the danger. For a spill, that takes proof of how long it was there.
Government property. A city, county or school district usually owes only the lower duty owed to a licensee, unless you paid to use the property. Injury claims against a Texas city are capped at $250,000 per person. Civ. Prac. & Rem. Code §101.022, §101.023
When the government already knows. The formal notice rule does not apply if the government body actually knew someone was hurt. An incident report may not prove that, so written notice should still go out on time. Civ. Prac. & Rem. Code §101.101(c)

Questions
Slip and fall questions
Who is responsible when I slip and fall in a store?
Usually the business that controls the floor where you fell. It can be responsible when it knew or should have known about the spill or hazard and did not clean it up or warn you in time. The building owner, a cleaning company or a contractor can share the blame, depending on who controlled the area.
What should I do right after a fall?
Get medical care first, even if the pain seems small. Then report the fall to the manager, ask for a copy of the incident report, take photos of the spot and your shoes, and write down the names of witnesses. Do not give a recorded statement to the owner's insurer before you talk to a lawyer.
The store says it didn't know about the spill. Do I still have a case?
Possibly. Texas law also covers dangers the owner should have found. That usually takes proof of how long the hazard was there, such as camera video, cleaning logs or a witness who saw it earlier, which is why we ask for that evidence quickly.
There was a wet floor sign. Can I still bring a claim?
It depends on whether the warning was enough. A sign placed far from the spill, hidden behind a display, or pointing to a smaller danger than the real one may not protect the owner. We look at where the sign stood, what it said and what you could see.
What if I fell at my apartment complex?
The landlord is usually responsible for the areas it controls, such as stairs, breezeways, walkways, parking lots and pools. Repair requests you sent before the fall can show that management knew about the problem, so keep every email, text and app message.
How fast do I need to act after a fall on city or school property?
Right away. Texas generally requires written notice to the government body within six months of the fall, and a city charter can set a shorter deadline. The notice must describe the injury, the time and place, and what happened.
